Perrigo says wins lawsuit related to heartburn tablets
June 6 (Reuters) - Generic drugmaker Perrigo Co. (PRGO.O) said a federal court ruled in its favor in patent litigation involving its over-the-counter Famotidine tablets used for treatment of heartburn due to acid indigestion.
Perrigo said it had been sued by Johnson & Johnson's (JNJ.N) McNeil unit and Merck & Co. (MRK.N) for infringement of a patent related to the formulation of Pepcid tablets, which are distributed by the two companies.
The U.S. District Court for the Southern District of New York ruled on Tuesday that the patent is invalid, the company said in a statement. Following the FDA approval, Perrigo will begin marketing Famotidine, it added.
