Sun Mar Health Care Claims Ownership of Sold Facility

LONG BEACH, Calif., Jan. 21 /PRNewswire-USNewswire/ -- Documents signed under
penalty of perjury in 2006 and 2007 by Sun Mar Health Care's and Sun Mar
Management's chief financial officer, which they filed with the California
Office of Statewide Planning & Development, inaccurately lists Courtyard
Healthcare Center in Davis, Calif., as one of Sun Mar's 18 California skilled
nursing facilities.

The revelation came to light when Courtyard Healthcare Center was included in
a class action lawsuit (Case #30-200800037875), filed Jan. 10, 2008 in Orange
County Superior Court against Sun Mar Health Care, Inc., Sun Mar Management,
and its 18 California skilled nursing homes [see list by city at end of
release] on behalf of Warren Richardson, by and through his Attorney in Fact
Marlene Miller, on Richardson's behalf and on behalf of all California
citizens who resided in, or are residing in, one of the company's California
facilities from Jan. 8, 2005 through Jan. 5, 2008.

"Apparently Sun Mar's paperwork is in as good a shape as its facilities," says
Long Beach, Calif., plaintiff attorney Stephen M. Garcia of The Garcia Law
Firm. "Sun Mar filed papers in 2006 and in 2007 with the OSPD claiming it had
a 37 percent interest in Courtyard Health Care. In reality, Sun Mar sold 100
percent of the facility in April 1999. Courtyard Healthcare Center will be
dropped immediately from the suit."

The papers were signed under penalty of perjury by Sun Mar's chief financial
officer and secretary of the corporation, William Presnell. The same form
lists Frank Johnson, Blaine Hendrickson, Eli Marmur and Irv Bauman as owners
with at least five percent of the for-profit company that is headquartered in
Brea, Calif.

"Sun Mar facilities have a long history of citations for deficiencies," says
Garcia. "In fact, their Fontana, Calif., facility, Citrus Nursing Center
earned itself a double-A citation -- the worst -- last February when a
91-year-old resident was improperly moved, dropped on her head and died nine
days later from what the coroner described as blunt force trauma to the head.
From paperwork to care, this company seems to have such extensive problems
that I can only shudder at the type of care, or lack of it, that I imagine its
residents are receiving."
