CA Labor Commissioner Debars Campbell Based Contractor from Public Works Projects

SAN FRANCISCO--(Business Wire)--
In a continuing enforcement effort of California`s public works laws, the State
Labor Commissioner issued an Order of Debarment against All Floor Commercial and
Residential Flooring of Campbell and company owner, Salvador Elias Perera,
prohibiting them from bidding on or receiving any public works projects for
three years. The prohibition, officially known as a debarment, begins on May 15,
2009. 

"Our investigation revealed serious violations of the public works laws and a
clear intent of fraud against employees and the awarding bodies on two separate
projects," stated California Labor Commissioner Angela Bradstreet. "I cannot
allow a company to continue operating while deliberately taking advantage of
their employees and the tax payers who fund these public works projects." 

The Department of Industrial Relations` Division of Labor Standards Enforcement
(Labor Commissioner`s Office) investigation uncovered violations of California`s
public works laws at two separate library projects, one in Santa Clara County
the other in Monterey County. With the work done in 2007 and 2008, investigators
uncovered evidence that All Floor Commercial and Residential Flooring willfully
and fraudulently:

* failed to pay proper prevailing wage rates 
* misclassified workers 
* failed to pay travel and mileage reimbursements 
* falsified certified payroll records 
* falsely reported work hours of employees

The investigation revealed that the contractor maintained two separate sets of
books in which they falsely reported dates, hours and projects that employees
worked on. In addition, the contractor routinely misclassified employees as
lower paid laborers to avoid paying the higher wage. In some cases they were
paid less then half the required prevailing wage for their true classification. 

"The debarment proceedings are necessary to remove employers operating in an
illegal manner at taxpayer expense and to the detriment of employees on public
works projects," added Bradstreet. "The action that I am taking will help to
create a level playing field for legitimate employers operating in this tough
economic time." 

The DLSE adjudicates wage claims, investigates discrimination and public works
complaints, and enforces state labor law and Industrial Welfare Commission wage
