Bauer Commends Supreme Court Ruling in the Ricci Case: Applauds the Use of
'Martin Luther King Test'

WASHINGTON, June 29 /PRNewswire-USNewswire/ -- Former presidential candidate
Gary Bauer on Monday commended the 5-4 ruling of the Supreme Court in which
the high court sided with the U.S. Constitution in protecting the rights of
white and Hispanic fire fighters who had earned promotions through testing
which were denied when no black fire fighters achieved the same results. "The
Supreme Court followed the 'Martin Luther King test' which holds that
regardless of race, creed or color, all people should receive equal justice
under the law," said Bauer. 

The president of American Values and chairman of the Campaign for Working
Families made the following statement: "Too often today business and
government officials enact hurtful and illogical policies to avoid lawsuits by
a litigious few. But as Justice Kennedy wrote, 'Fear of litigation alone
cannot justify the City's reliance on race to the detriment of individuals who
passed the examinations and qualified for promotions.' 

"This case has even more significance as it came through Supreme Court
nominee's Sonia Sotomayor's court.  Sotomayor sided with the city and against
the fire fighters who successfully passed the promotion exam.  If this case
had been a promotional test for Sotomayor, she would have flunked it as a
majority of justices disagreed with her politically correct reasoning.  It is
a prime example of why senators should thoroughly scrutinize her record and
take every opportunity in the upcoming hearings to expose her left-wing
ideology."
