BACKGROUND:

In 2007, the U.S. Environmental Protection Agency sent letters to residents in
the Elmira Heights area, asking for permission to test the air in their homes
for traces of trichloroethylene, or TCE, a common industrial solvent.
Preliminary testing revealed high levels of TCE, requiring the installation of
mitigation systems in a number of homes. Since then, sporadic testing has been
conducted. In an email to a Weitz & Luxenberg media spokesperson, Isabel Rocha
Rodrigues Remedial Project Manager, U.S EPA, said she had plans to return for
further sampling and testing before the end of the year. 

"The issue of whether Elmira Heights families living in the untested houses are
safe from breathing in harmful chemical vapors remains unresolved," said Hadley
Matarazzo, a Weitz & Luxenberg P.C. attorney in the Environmental and Toxic
Torts unit. She added, "All families living in the Heights have a right to a
clean and safe environment and a right to use and enjoy their homes. We would
like to meet with them to discuss the pollution and the impact it has had on
their lives." 

According to an article in the Star-Gazette, the EPA first began the testing to
determine whether the former Purolator Facet Superfund cleanup site in Elmira
Heights was affecting air quality in houses around it. When groundwater or soil
contamination exists, there is a potential for gaseous components of the
contamination to enter homes near the contamination. This phenomenon is known as
"vapor intrusion." 

The EPA found high levels of TCE emanating from the Purolator Facet facility.
Located at 2243 Corning Road, the plant has been a location for makers of
automotive parts since 1895, and remains an active industrial site. TCE was
widely used for metal degreasing in industrial operations and is now a common
contaminant at hazard waste sites and many federal facilities. 

TCE vapors, if breathed in small amounts, can cause dizziness, headaches or skin
irritations. According to the Agency for Toxic Substances and Disease Registry,
breathing high levels of TCE over a long period of time can cause nerve, kidney
and liver damage.
