UPDATE 1-Medtronic in patent suit over Carelink System
* Medtronic sued for patent infringement
* Medtronic says will "vigorously" defend itself
(Adds dateline, comment from Medtronic)
CHICAGO, Dec 10 (Reuters) - Medtronic Inc (MDT.N), the world's largest stand-alone maker of medical devices, was sued by Medgraph Inc, which claims that Medtronic's Carelink System violates its patent, according to a court filing.
In a lawsuit filed on Dec. 2, Medgraph claims the patent infringement by Medtronic was willful, deliberate and with full knowledge.
Medgraph specializes in communicating diagnostic information between patients and their medical care givers, according to the company's website.
Separately, Medtronic said in a regulatory filing on Wednesday that on Sept. 16 it received a subpoena from the Office of Inspector General for the Department of Health and Human Services in the District of California requesting production of documents relating to its cardiac rhythm medical devices.
Medtronic said in the filing it will comply as required with the terms of the subpoena.
Reached for comment, a Medtronic spokesman said: "After an initial review, it does not appear that any Medtronic product infringes any claim of the asserted patent, and the patent itself may not be valid because the claimed invention was already made by several others before Medgraph applied for its patent.
"The Complaint has not been served on Medtronic. If it is, Medtronic will vigorously defend the claims." (Reporting by Santosh Nadgir in Bangalore; editing by Jon Loades-Carter and Andre Grenon)
