Virginia takes healthcare dispute to court
WASHINGTON |
WASHINGTON (Reuters) - The Commonwealth of Virginia on Tuesday filed a lawsuit challenging the overhaul of the United States' healthcare system after President Barack Obama signed the massive plan into law.
The complaint was filed against Kathleen Sebelius, the U.S. Secretary of Health and Human Services in the U.S. District Court for the Eastern District of Virginia, and said the health law's requirement that all Americans buy health insurance "imposes immediate and continuing burdens on Virginia and its citizens."
Virginia has passed a law saying its residents are exempted from the fines the U.S. government can impose for not owning health insurance.
"The collision between the state and federal schemes also creates an immediate, actual controversy involving antagonistic assertions of right," according to the suit, which was filed by Attorney General of Virginia Kenneth Cuccinelli.
Earlier on Tuesday a group of 13 states filed a similar lawsuit in Florida.
