U.S. court rules for Abbott's diabetes test patent

WASHINGTON May 25 (Reuters) - A U.S. appeals court that specializes in patent disputes ruled on Wednesday that a lower court was wrong to declare an Abbott patent unenforceable, and sent the case back to the lower court.

The U.S. Court of Appeals for the Federal Circuit ruled in favor of Abbott Laboratories (ABT.N), saying it could sue for infringement to enforce its patent for disposable blood glucose test strips.

It had sued Becton Dickinson and Co (BDX.N), Nova Biomedical Corp, and Bayer Healthcare LLC (BAYGn.DE).
