Hagens Berman Sobol Shapiro, LLP Announces Preliminary Approval of Class Action Settlement

Hagens Berman Sobol Shapiro, LLP: A settlement has been reached in the lawsuit captioned Mahan v. Trex Company, Inc., No. 09-CV-00670 (N.D. Cal.). On August 27, 2013, United States District Court Judge Jeffrey S. White entered an order preliminarily approving the settlement.

The named plaintiffs in this matter have alleged on behalf of themselves and a nationwide class that certain Trex first-generation, non-shelled wood-plastic composite decking, railing, and fencing products exhibit certain defects. Trex denies these allegations. The proposed settlement is intended to resolve this dispute. The Court has not decided in favor of either the class or Trex. The Court’s role in the settlement is to make sure it is a proper settlement that is fair, reasonable, and adequate for all class members.

Settlement class members include all Persons in the United States or its territories who own Trex decking, railing, or fencing built with Trex non-shelled product purchased during the Class Period, which is defined as the period between August 1, 2004 and August 27, 2013. Settlement class members have certain legal rights and options with respect to the settlement.
