It seems on the basis of Hamdan’s lawyers’ argument, then any NAZI in WW2 would not be guilty on the grounds that they were just following orders and they “needed” their salary. Insanity.
Whether he knew OBL personally or not, he was clearly captured on the field of battle and shown to be closely linked to the leadership of the group – even if you stipulate all that his lawyers’ claim.
He took money in exchange for supporting terrorism with his personal service. If this man is not guilty, seems some concentration camp guards would deserve an apology – which the, of course, don’t.

Another reason to keep these animals off American soil. This POS is going to walk.

@AZWarrior

He ‘walked’ four years ago because he served out his sentence.

But don’t worry, they released him to Yemen…where indefinite detention, charges and trials have been replaced with drone strikes. They may only have a 4% success rate in terms of killing their targets, but on the bright side, there’s no appeals process.

I don’t think you read the article. Nothing that you just said is relevant to why the conviction was actually overturned.

JonPu you make an execellent point here and agree to all the premise of your comparisons. Except that aghanistan was not the invader they were the “invaded” That’s why prisoners were sent to GITMO outside US jurisdiction, but then the whole thing is so convoluted and shrouded in mystery that we have no clue what arguments are made in a close military court. Something more for the candidates to fight about in their debates.

What happens in Gitmo should stay in Gitmo. This is the classic example why accused terrorists can not be tried in the US.

What’s the monetary price tag on this? How much has it cost the U.S. to build an illegal prison; house and guard prisoners who may or may not be criminals; set up an illegal “justice” system; pay the salaries and benefits of people to torture other people who may or may not be criminals; prosecute people who may or may not be criminals in an illegal court system; litigate the legality of all of it; and to pay the salaries and entitlements of so-called representatives to draft and pass legislation – who weren’t even smart enough to make it retroactive to include the reason they drafted and passed it in the first place? The worst part of it is that the American people – myself included – manipulated by fear tactics, stood by and allowed the filth that is George W. Bush and Dick Chency (emphasis on “dick”) to shred our Constitution and international credibility and use it for toilet paper. A thousand years from now, archaeologists will find “We the people . . . ” partially preserved in the bowels of the DC sewer system and won’t have to wonder what caused the collapse of our civilization.

One of the many campaign promises made and broken by our current president was to repeal the Patriot Act. He has since reinstated it twice and assassinated at least one American citizen without so much as a by your leave. Don’t think for a second that Romney, a walking, talking special interest, will be any better. Shame on us if this is the best we can do.

No problem — the dictator in chief can just execute him with a drone strike. There is no rule of law there are no courts.
