It could be debated at the merit of a ‘good deed’ – that involved selling sperm on Craigslist.

At least these ladies are lucky he didn’t have some kind of disease.

Anyway dude – if they press the issue – file for custody, since the parents can’t provide for the child, it should be easy.

Whether verbal statements or written document, an agreement between persons constitutes a legal contract. Three people agreed to certain conditions earlier which is no different than any of the myriads of ways we humans agree to certain things in the course of our lives. It would appear that it is the two women who have violated their agreement with Marotta. A change in the women’s circumstances does not void the orginal agreement made.

I shook my head as each one of those commenting unloaded their bias and disdain on a man they never met who was trying to help a couple by donating his sperm for free. You know, the point of the story…

Then bobber, the prolific misogynist gun toting Obama hater, quotes Jack Nicholson of all people, as he displays his disdain toward women and lack of reading comprehension. (reason and accountability are NOT jack’s forte)

Bobby, diplomacy is another word for restraint. Winston was a misogynist old drunk womanizer… who was respected my other men because he got his liquid courage to be less than politically correct and speak his mind. (Hmmm Nicolson seems to be close to that title as well, so I see a theme here) The fact that Winston failed more often than not seems to be lost… because he was a great orator and BSer, which makes for great quotes to use in a comment section.

Let me sum it up for bobber. After the man donated for free, his sperm, the woman were not doing well financially so requested assistance. The Government pressured the woman to reveal the father’s name because the sperm donation didn’t go through proper channels and the man is by law the father of the child and the child welfare is the law’s main interest. The sperm donor is not upset with the women as they still speak.

Also, even if he is found to be liable for child support, it would be easy for them to return the money immediately after he has paid the child support payment.

I would be interested to know if he can go after them in civil court for breach of contract for failing to uphold their end of the bargain.

Donating through a licensed physician will cost more to do, but being safe from state government harassment in the future is worth the expense. Also, if these ladies could not afford to care for a child, having to obtain sperm through normal channels might have ruled them out until their finances were sound.

The ruling in that case was that the other “mother” was responsible for child support since it was she who delivered the sperm via a turkey baster. The court held that it was the one who planted the seed who was responsible for the baby.
