Quite correct! Yet, such a ruling would ‘never’ get through a US court. Internet functionality has not permeated that level of the American market. It is not clear ‘when/how’ Univeral Broadband will be implemented in the US. In such an environment, market forces have hijacked public policy to the detriment of the American people. I.e., “Ignorance is Popular”. This is an area where ‘regulations’ are being used to maintain the ‘status quo’ oligarchies in the communications industry.
