Obama deemed pro forma as recess instead of in session. The court simply said the Executive Branch doesn’t get to decide if the Legislative Branch is in session or not. Only the Legislative Branch may decide that. Since Congress was deemed in session by the court (they agreed with the Congress itself), the appointments were invalidated.

Can you tell how many recess appointments Bush made? Then how many Obama has made?Then explain why Republican recess appointments are not a dictatorial power-grab, but Obama doing the same thing is.

Obama tried three times to get Congress to agree to his nominations. Three time Republicans blocked his nominations. Isn’t it odd how the Republican blogosphere forgets to mention the bit about Republican obstructionism.

Don’t get so hyper, it will be slapped down. It has to be because is contradicts earlier rulings, and ought to be because it is based on linguistic arguments that are completely wrong.

The next opportunity comes in two years. Join activist groups, make calls for your candidates, write to Congress, and get involved.
