this is really about losing access to the new technology. notice how the only smartphones currently out with the flexible displays are from LG and Samsung? yeh, there is a reason for that.

you can sue over software patents all day long; you might even win. but at the end of the day, you are going to need the newest panels and peripheral hardware. not only that, you are going to need it at some large scale of manufacturing… hmm, care to guess why companies tend to pick samsung?

it all boils down to the fact that samsung has most of the smartphone makers over a barrel. there are only two panels worth having. one is from samsung and the other conveniently, is from LG, for whom apple has an ‘exclusivity contract’ to license retina from them… apple can pretend it has the money to negotiate new contracts to have their new processors and panels make elsewhere, but they are kidding anyone but themselves.

hence all these ‘patent negotiations’

samsung can say no to everything. get a different OS, which isnt as easily litigated [tizen, natch] and continue to be the monopoly on the best panel technology, regardless.
