What the court ruled was that no further licences should be issued under the JARPA II program in its current form.

The court also specifically accepted that lethal sampling was acceptable for research purposes.

So if Japan were to modify its program and have it approved, it could legitimately conduct lethal scientific research upon whales in Antarctica.
