Judge strikes down Colorado gay marriage ban, stays ruling

This decision means incest will also be legal in Colorado after the stay. Colorado law prohibits a brother from marrying a sister, but doesn’t prohibit a brother from marrying a brother, or a sister from marrying a sister (see CRS 14-2-110(1)(b)).
And if a brother can marry a brother, why can’t a brother marry a sister? The 10th Cir recently held that marriage should not be denied someone based on gender. Further, the 10th cir also determined that whether or not a couple can have kids is irrelevant to determining if two people can wed.
It looks like we will also be stuck with incest marriages in Colorado.

And the dominoes continue to topple. Well done!

At this pace it won’t be long before America will be finally living up to her espoused ideals, as codified in the equal protections clause of the 14th amendment.

It’s about time. If marriage was about procreation or tradition, it wouldn’t have changed so much in the last 100 years.

The comparison between same-sex couple marriage, polygamy and incest denote the same mentality used when agreeing on the illegality of a black person marrying a white person. It is unconstitutional to discriminate against gender and the fact that Colorado can grant civil unions and not a marriage certificate proves the fact that same-sex couples are being treated as second class citizens. Many people, not only in America but in the world, have no desire of procreating and decide to marry people who share the same desire. If same-sex couples cannot marry due to the misconception that the world population will be endangered if they do, then a fertility test should be administered to couples before they are wed to ensure their generation is passed on. There is no basis for the argument of not allowing gay couples to marry and so anti-gay-marriage individuals, who are not affected by the court rulings in any way, are constantly searching for comparisons or reasons as to why gay marriage will cause the next apocalypse in the world. There are much greater problems to focus on such as the bigotry being taught to future generations and the violence that tolerance can prevent.
