So is Herbalife trying to suggest that the SEC inquiries are nothing but an interaction that they themselves initiated? If that were the case, why not write it in the 8k? Oh, yes, because intimating something misleading via a journalist doesn’t infringe upon the law.
Any article mentioning Loeb’s stake as though to imply that he has faith in Herbalife’s business ought also to mention that he has since sold most of that stake, and that this was nothing but an opportunistic trade in a stock that was clearly primed for a bounce and a short squeeze. Loeb’s trade does not indicate that he disagrees with Ackman.
