Excellent news, the Obama regime is already acting in contempt by still pushing ahead with this now illegal Democrat bill against the courts and against the will of the American people, so well done congress, put a stop to this lawlessness!
If the House votes to not fund the Health Care Legislation, isn’t that the end of it? There is nothing the Senate can do to challenge the House vote, right? It just dies right there in the House.
Wouldn’t that be wonderful? It would mean the United States is actually going to honor the Federal Court Ruling on the Unconstitutionality of the Law, and not take any further action on it until some Court says otherwise, if ever. None of the States of the Union would be able to exercise any of the unconstitutional actions for which the Law calls.
I would appreciate any further discussion of this issue by others who are more schooled on the operation of the Legislative Branch and the Constitutional issues raised here than I am.

It seems to me that unless the House passes legislation to include funding, the health bill still is not funded, no matter what the Senate or President does. The most that non-action by the Senate can do is force the House to reconsider the budget.
The House holds all the cards here, and if it sticks by its guns it will fall on the Senate and President to deal with a budget with no health care funding. How long can the twom of them punt that one?

Unless I missed a news report somewhere, Obamacare cannot be enacted or funded. It has been ruled unconstitutional. Unless or until the Florida decision is overturned, it is no longer a valid law. Statements by Administration officials and Senate majority members that the judge did not enjoin enactment are disingenuous at best. The act of declaring it unconstitutional nullifies the law. No injunction is necessary.

It is amazing how it applies for what we is going on today, except, of course, that most of those things he talked about are today implemented in government. That is, our government today has moved considerably into socialism. It is amazing how the language “pay for tax cuts” just became common jargon among the political classes. And Obama and the Democrats accelerated greatly our move towards socialism the last 2 years. Cutting $32 billion from a $3.7 trillion budget is another sick joke being played on the American people. That’s comparable to a car dealer reducing the price of a $37,000 automobile by only $32. The effect of the legislation will be how it is worded. If there is no enforcement funding, that sounds good, but it doesn’t help with the uncertainity that our hyper-active government has created. businesses have to plan.
And the federal judge’s rulling only kicks the matter upstairs. If you’ve been up on it, since the Dem’s took the severability clause out of the legislation, the decision to push Obamacare forward depends on whether Kennedy sides with the 4 other statists on the Supreme Court. If he does, we’ll have to slog it out every legislative step of the way.
I wouldn’t get wrapped up in the $100 billion number. Its not enough to affect the monsterous deficit, while killing off Obamacare is a good session’s work all by itself.

No problem with a repeal of Obama Healthcare, but can we get some alternatives. Unless you feel there is nothing wrong with the healthcare system?…….You people think the government “coming between you and your doctor” is any different than the current for-profit insurance company in between you and your doctor. The physician is not in control of treatments, procedures, or even medicines prescribed. These are dictated by the patients insurance company. I work in a major cancer institution and I see it every single day. Im not referring to protocol and off-label use either. Please dont follow-up with rants about socialism or marxism or whatever. I truly am just looking for alternative ideas as they are hard to find past all the arguing and media slant in both directions.

This show down does look bad for Obamacare. I find this very troubling. How can we compete in the world market if we cannot afford to provide health care. You call it socialism, I call it part of being in the first world. As the ONLY first world country that doesn’t have nationalized health care, we look more like India than Japan, and more like China than Germany. As the leader in the world in consumption, industrial output, and GDP, it is AMAZING that we cannot agree to provide health care for our citizens. I say ditch our military and focus on schools and health. If we did that then business would have an educated and healthy workforce like Japan and Germany. If you want to stay ahead rather than slide into 3rd world status, then you have to invest in the quality of your society.
This is a great first step, but they’ll lose momentum, and possibly public sentiment, if they forget to keep explaining the rationale and how it ties back to a conservative philosophical approach to the issue. Conservatives need to be fearless on this one and keep teaching.

Since all funding bills originate in the House, it shouldn’t be difficult to block all funding for the Health Care legislation. If the majority Dems in the Senate chose to block all future funding bills because the DON’T include funding for the Health Care bill, many of the the 23 up for reelection in 2012 will seal their electoral fates.
While I’m glad to see people fighting against national health care, I do hope that we will also propose free-market reforms.

Only The House can authorize the expenditure of funds, it does not mater what the senate wants when it comes to appropriations.
One way or the other, the Obamacare monstrosity will be severely curtailed, if not repealed and replaced. My hope is that the socialist democrats in the Senate continue to ignore and reject the clear will of the American people who want the health care bill either repealed or largely restricted, so that they lose control of the Senate either this year or in 2012.

A 2% cut in the deficit is hardly worth getting excited over. Republicans are going to have to do a whole lot more to slash the size of the federal government if they are to become trusted by the job producers. Jobs will return quickly only if the republicans remain merciless in their opposition to Obamacare and massive deficit spending. Either way, the Senate Democrats may take a beating in 2012 for their refusal to repeal Obamacare. 2012 is looking very good for the republicans. Come on, jobs!!!
Blocking implementation of a national health measure whose provisions are widely liked hardly sounds like a vote-winning strategy. It does, however, sound like a good red-meat fund raising tactic. Since the money garnered from the fund raising is subsequently used to broadcast deceptive ads that do win votes, the whole combination makes a creaky kind of sense. Yet I can’t help wondering how much longer the Republican assumption that their voters are both ignorant and inattentive can continue working so well. Although that assumption has proved its correctness for at least 60 years, the internet age may yet invalidate it.

Hopefully, the lack of funding will keep the law from being implemented until it is ultimately ruled unconstitutional. Also, as funding is held back, the public will continue to demand that the law is replaced by something that works (i.e. something that will get funded).
Why is it that everyone has disregard every spending cut as being too small and thus not worth the trouble? It’s not like there is ever going to be one giant spending cut that just guts everything all in one bill. We didn’t get to trillion dollar defecits with one bill and we won’t get out of it with one bill. EVERY spending cut should be supported because it is going to take a LOT of them. Each one might not seem like much compared to the monster debt, but they add up over time. If you had $30K of credit card debt would you justify every $50 new expenditure as nothing to worry about due to it’s comparatively small size? That’s the same degree of idiocy as not supporting any given spending cut for not being large enough.

@Sensibility, the Obamacare law has already been ruled unconstitutional by Federal Judge Vincent. His ruling has not been stayed, and there is nothing pending before the SCOTUS. Regardless of whether one subjectively thinks it is good or bad, as of right now, it is objectively not a law and therefore can not be funded.

A federal court has already ruled that the law is unconstitutional. Any fund supplied should be denied until an appeals court and/or the Supreme Court overrules that decision. We have a nation of laws people. Can we pretend to follow them or should we just throw in the towel?

If you plan on Rahming through legislation, you’d better make sure you’re going to still be in power when the implementation phase comes. What we’re going to have, because of their lack of intelligence, is a 2 year fight over implementation, an election that says, “Yes we really did say we wanted this repealed and you didnt do it so, BAH-BYE.”
Ironically, it didn’t have to be this way. Had the Democrats brought in the Republicans and put some of their ideas in the bill, they Republicans would have gone home and sold this “bi-partisan bill” to their constituents. It’s really pretty elementary political science, yet the Democrats failed to do it. I’m sorry for their failure, but this is the result. Just think, perhaps this is why the Republicans didn’t push their plans for Social Security Reform.
Guess it depends on how one phrases it. Are the Republicans blocking funds to implement Obamacare? Or are they refusing to fund it? Is the 112th Congress obligated to fund the law passed by the 111th? Certainly the people who voted in the November, 2010 elections showed their displeasure with the 111th, but the electorate that elected the 112th Congress was markedly different in size and composition than the one that elected President Obama. We will see how it plays out in 2012.
Don’t forget about the states! The individual states have the right to uphold the unconstitutionality of Obamacare and refuse to fund it. This may be the linchpin. There is still hope that this Obamanation can be put to rest.

the Constitution provides that “All bills for raising Revenue shall originate in the House of Representatives.” As a result, the Senate cannot initiate bills imposing taxes. Furthermore, the House of Representatives holds that the Senate cannot originate appropriation bills, or bills authorizing the expenditure of federal funds.

the congress de-funds the a “bill” the Senate cant do anything about it.

Although I appreciate the gesture, the Republicans are not taking real steps to reform government. Thirty five billion dollars is a drop in the bucket. There is one area to start first, reform the tax system. Unlike GW who tried to reform social security, the majority of voters would support the abolition of the IRS. Replace this convoluted tax system with a consumption tax and that will take power from Washington bureaucrats. Even though it won’t get by the democrats, it will put huge pressure on business as usual. This would be a real start to a real revolution. Without radical reform of every form of the federal government, we will see continued tax and spend policies, let’s face it the American public are fat and lazy and have no trouble letting someone else pay their bills. That said, the laws of Capitalism will prevail eventually. That will not be too far in the future.

This is a farce. A duly-elected Congress passed the legislation, and it was signed into law. The attempt to repeal the legislation failed; its legal standing is currently unchanged. To refuse to fund those programs and initiatives mandated by the legislation smacks of negligence and dereliction of duty. If this were any organization other than Congress, civil charges would be brought against the leadership.
They had better follow through on this. 100%. Any Republican who doesn’t is out at the next election cycle. Obama,Reid,Pelosi started this war on the Constitution and the American people. And it is a war. Now they need to be fought at every turn and they need to be repudiated. In 2013 there can be health care bi-partisan legislation that doesn’t destroy the American system. While fiscal bills must originate in the House of Representatives, ALL bills holding the weight of law (such as a budget bill) must be passed by both houses and signed into law by the president. If the House passes any legislation which fails to fund LEGAL mandates (such as HCR), then the Senate and president both have the ability to force reconsideration. If the House Republicans want to shut down government by failing to fund a valid law, that’s their prerogative. When Gingrich tried it in the ’90s, the result was less than positive for his party.
Time to embargo all Federal funds for payment of health benefits to Members of Congress, their dependents and all Congressional retirees. A year after the people get their health care back, let the Congress get theirs back. If the People do not get retroactive full care, then neither does the Congress. What is sauce for the goose is sauce for the gander.
Of course such an embargo would just be a temporary inconvenience during investigations of allegations of fraud and abuse by Congress of their health and retirement plans. Such an investigation should be extraordinarily thorough and not funded until the People’s health care is funded fully. They call it “due process”.

Everyone does have affordable healthcare. I know people who can’t affort insurance through the private sector, and have purchased it through one of my state’s programs for their children. As for themselves, they can go to any hospital and be plugged into a network of doctors (even for mental health) that provide their care for free. It’s the middle class like me who saw their premiums go up by a couple hundred dollars each month as the result of Obamacare–and I don’t qualify for any government program. You just don’t get it–we have the best system in the world, and under Obamacare, it’s going to be destroyed, not to mention it is UNSUSTAINABLE. Eventually no one will be able to afford it. But I don’t know why I waste my time. People like you have no ability to critically think!

To Tonylord. What is wrong with partisan battles? Our system is set up this way for a reason. We are supposed to battle it out. They are not supposed to get along. The Nation is supposed to be divided…Its divided among the states. We are not the ‘Federalist States of America’ We are the ‘United States of America’ United by the Constitution. Each State is a laboratory of Democracy, with success and failure of idea’s to be shared by all. Why not try this out at the State level, see what works and then implement it one state at a time. No. They are told by their party leadership which way to vote, and the vast majority do so most of the time. Is it right? No. Is it legal? Yes.
How does Congress “prove” a bill’s constitutionality? Quite simply, it doesn’t. There is no provision in the Constitution for a piece of legislation to be reviewed by a judicial body to determine its constitutionality prior to its passage; Congressional legal counsel, in an advisory role, determine whether or not specific parts of bills will meet judicial scrutiny. If you want a system where a constitutional court becomes involved in the legislative process, I recommend that you move to France. Ultimately however, in the United States, constitutionality can only be determined before a court AFTER the bill has been passed into law. With all due respect to the arm-chair legal experts here, the one ruling by a district-level federal judge in Florida does not invalidate the health care reform laws in the nation as a whole; as other courts have either tossed out anti-HCR suits OR ruled that HCR is constitutional, the Supreme Court will eventually have to make the final determination. Until such time, HCR is law, and Congress has a responsibility to see to its effective administration through funding and oversight. If any when HCR is deemed unconstitutional, Congress can then take active steps to dismantle its structure; the House GOP’s threats are akin to a parent saying, “I’m not going to build a room for my newborn daughter because she MIGHT get sick and die or MIGHT be run over by a truck.” The fact of the matter is 1) the legislation was passed by both chambers in the previous Congress, 2) it was signed into law by the president and 3) it has not been overturned by the court of final review (viz the Supreme Court); as such, it is a currently VALID, binding law.

Everyone says the bill has been deemed unconstitutional. Isn’t it possible for the Obama administration to find another federal judge(s) to deem it constitutional? Isn’t that part of the problem? I’m not up to speed on law, but it seems like these decisions go back and forth all the time.
The law has been declared null and void by a federal court. It is definitely unconstitutional, and most probably illegal to fund it. That simple fact should be at the forefront of every legislators mind when they consider the budget.
If the Senate wants to disregard the will of the people as expressed in the November election then shut down the government. Its certainly not representing the will of the people who think Obamacare is horrible. The Democratic party was fine when it truly represented working Americans. Good. It is not that we do not need a healthcare overhaul, it was how it was done, without half of the country’s opinion on the deal. It should be done piece by piece with transparency and enough time to look at each bill. Before anyone new people are covered, we need to fix what is wrong now, make the cuts that we cannot afford as it is, then put those other people on welfare medicare if they need it and they qualify.
This is the Super Bowl so to speak. Republicans will offer cuts and the Democratic Senate will not pass it. This will be their PR nightmare as it will extend the belief that they are just spend happy and will not sacrifice. The Republicans are at least for now matching their rhetoric. Just because one Judge ruled it unconstitutional, it doesn’t mean it is. What about the two judges who said it was constitutional?
You would think that those who desperately want to reduce the debt would be in favor of this legislation. Instead they just complain and come up with less than adequate solutions to reduce health care costs.
Hate to break it to you but a ruling by a Federal Court judge doesn’t render a law unconstitutional. Two FC judges ruled the law constitutional, 2 other FC judges have ruled parts or all of the law unconstitutional. All rulings are being or will be challenged- you can be sure of that. Eventually, this will be decided in and by the Supreme Court- they will determine if the law is constitutional or not. Amazing how many commenters here are so poorly informed on this point.

Constitutionality is far from decided, it is too early to declare it dead: two Fed courts have ruled in favor of the law and two have ruled against with one of those only questioning the mandatory purchase requirement. Unless there is a stay ordered by a court, all continues until the next level court rules.
2. Yes, spending bills must originate in the House, but an appropriation bill is a law that requires both chambers to approve. If the Senate passes a different bill, it must go to a conference committee to work out differences so both houses will pass the same bill. Absent that, there would be no appropriation but such a bill covers a whole bunch of other programs that no one would want fully stopped.
3. The $3,700 billion is the total expenditure of the government. There is also $2,200 billion in taxes and revenues. This leaves the $1,500 billion deficit. (I think it is easier to keep working in billions so that all the decimal places get straight.) While we are talking about numbers, with 300 million people, one billion dollars works out to about $3 per person. The deficit comes to $4,500 to $5,000 per person in the US.
4. I would advise looking at some reliable data sources for the functional breakdown of Federal spending. Many people have mistaken ideas about how much, for example, is in foreign aid (Ans. very little.) It is true that more than a quarter of spending is in Defense. It is time to start thinking very hard about our priorities without resorting to ill-advised and uninformed rants that assume it is all so simple. I doubt many people treat their own household decisions with as little care as I see here.
5. Unless macroeconomics has changed radically since I was in graduate school 40 years ago, a rapid drop in government purchases that isn’t replaced by a matching demand from private purchases is likely to have a deflationary impact on an economy with additional job losses. In my long career, I have yet to see believable evidence contrary to this. (Supply-side economics was a well-sold fraud.)
6. There is a lot of talk about impacts on small businesses. In common discussions, we might think we are talking about lawnmower repair shops or ten worker fabricating shops. In these cases, I can see where small businesses might struggle with providing healthcare. BUT, the definition of small business in the law is generally firms that employ 500 people or fewer. In some cases and industries, it can be 1,000 people. In most towns I know, any plant that hired 500 people would be a major player in the economy.
The Peoples business waits another day on a “Do Nothing” House. Their bet is not on our Presidents failure. It is a bet on the failure of the American nation. Sorry to burst everyone’s bubble here, but it’s not officially unconstitutional until the Supremes rule on it. I might add there have been federal judges that have ruled it is constitutional, and that is why we have a supreme court. Might want to check out a book on how the U.S. judicial system works.
Of course it is only about money, money has to be earned, therefore one needs to work, we must swim, but what if the swimming pool is (nearly) empty, money is thrown in, but there is a huge hole.

I believe twenty six states have challenged the constitutionality of The Affordable Health Care Act. At least a dozen of these states threw it out of court(as frivolous). Two federal judges ruled it constitutional and two did not…Va and Fla. It may take up to two years for it to move through the court system before it goes to the Supreme Court. To me this is an abhorrent waste of taxes. During the Bush Administration, The Medicare Part D Prescription Drug Act was passed and it mandates that as a Medicare recipient you must join or be fined approximately 1.5% increase per month on your premium(note not year but month)that you choose to not join. Since I, as a medicare recipient, only use two prescription drugs costing less than $300 for the year,it is not cost effective for my situation. However, it has helped others. What is the difference in mandating The Prescription Drug Plan (enacted during the Bush administration) and what is mandated in The Affordable Health Care Act? Why is Medicare Part D never questioned as constitutional? If the Republicans would spend as much time and effort on finding solutions to our problems rather than fighting/saying no, our country would be better off. It became clear to me what their interests were when they fought to keep tax cuts “for the rich” that would have helped reduce the deficit they propose to care about so much.
It can’t be done so it’s a nothing but a waste of time in the interest of posturing for the next election and campaign contributions.
I agree that George W was one of the worst presidents of all time. A real airhead. I tend to vote moderate republican, and I voted for the airhead the fist time, but not the second. The fact that George W was elected a second time is a real testament to American stupidity and a bad stain on democratic elections. George W showed a lot of guts (boldness is a good thing), but he had virtually no wisdom (common sense). The Romans two thousand years ago learned the hard way that it was not a good idea to elect the son of a previous leader. How many people in America know this important lesson of history. Almost none.
