If they have Cherokee blood, the same fraction required for all other Cherokee descendants, they should be considered Cherokee. If they don’t, then they aren’t Cherokee. How difficult is that?

What all articles neglect to mention regarding the non-Indian Cherokee Freedmen descendants is that they have not been a part of the tribe until the Cherokee Nation Supreme Court Ruling in 2005. From the passage of the Five Tribes Art in 1906, which was the final act of the US unilaterally dismantling of tribal governments, until 2005, the non-Indian Freedmen descendants have not been members of the tribe. However, over 1500 Freedmen descendants who also have Cherokee ancestors are enrolled in the tribes, and their citizenship will not be affected by this ruling.

It’s difficult because of the Cherokees are only using the Dawes Rolls to determine membership. Some members have listed Cherokee ancestry on other rolls, but not on the Dawes (due to various circumstance, too many to list here). The Cherokee Nation could have easily used the time and money spent fighting this decision to check and verify members who were listed on other rolls, but it’s clear that they have no desire to figure out who’s really who. As long as Chad Smith is in charge, that’s the way it’s gonna be.

My Great-grandmother on my father side was a descendant of slaves. My great-grandmother on my mother side was a full blooded Cherokee Indian. Now how am i supposed to feel about this decision? These people have learned to speak with “forked tongue” and have learned the ways of Andrew Jackson.
