Ex-Wife Fails in Bid to Remove Dr. Henry T. Nicholas, III from the Family Trust

SANTA ANA, Calif.--(Business Wire)--
An Orange County Probate Judge today rejected for a second time a petition by
the ex-wife of Dr. Henry T. Nicholas, III to gain control of the Nicholas Family
Trust. 

Judge Mary Fingal Schulte dismissed the petition of Stacey Nicholas without
permission to amend. 

"This is the second time we have argued that Mrs. Nicholas' petition was without
legal substance and something we regarded as nothing more than a publicity stunt
aimed at smearing Dr. Nicholas with outrageous and false allegations such as
death threats and men following her in gorilla masks," said Dr. Nicholas'
attorney, Richard Howell, a partner with Rutan & Tucker, LLP. "We are obviously
pleased with the court's ruling, and are also pleased that her efforts to gain
control of the Trust and to apparently influence the outcome of the child
custody dispute have failed in this action." 

Mrs. Nicholas filed the petition last November, the day before Thanksgiving,
alleging that she had no money and her ex-husband had had her followed by men in
gorilla masks. 

Last March 31, the Court rejected the petition, but gave leave to amend the
filing. Mrs. Nicholas then filed a toned-down complaint, which the Court
dismissed today without permission to amend.
