Boston Scientific says Medtronic awarded damages
CHICAGO, May 28 (Reuters) - Boston Scientific Corp (BSX.N) on Wednesday said a U.S. District Court jury in Marshall, Texas, found that the medical device maker had infringed patents held by rival Medtronic Inc (MDT.N) and awarded damages of $250 million.
Medtronic had alleged that some Boston Scientific balloon catheters and stent delivery systems infringed four U.S. patents held by Medtronic. Boston Scientific had claimed that it did not infringe and that the patents were invalid.
Boston Scientific said it had raised a number of defenses that were not considered by the jury but will be heard by the District Court on July 31.
Should those defenses prove successful, the jury's verdict would be set aside, it said.
If those defenses were not successful, the company said it would seek to overturn the verdict in post-trial motions before the District Court and, if necessary, to appeal to the U.S. Court of Appeals for the Federal Circuit in Washington.
