Settlement Reached in Luv n' care Intellectual Property Lawsuit Against Royal King MONROE, La., July 13 /PRNewswire/ -- Luv n' care, Ltd. and Admar International, Inc. announced today a settlement of their intellectual property suit against Royal King Infant Products Co Ltd. of Thailand. The lawsuit, instituted against Royal King Infant Products Co Ltd. in the U.S. District Court for the Eastern District of Texas, charged that Royal King had engaged in federal and state unfair competition, infringement, and dilution, by illegally copying Luv n' care's popular items for young children. The Thailand manufacturer was accused of infringing the rights in Luv n' care's products, packaging, and trademarks, including the famous NUBY(R) mark, to confuse consumers into believing that the unauthorized copies originated from Luv n' care, and to trade off of Luv n' care's good will in the marketplace. Under the terms of the settlement, Royal King agreed to permanently cease and desist from manufacturing and selling globally any further copies of sixteen of Luv n' care's products and their packaging, and any further versions likely to cause confusion. Royal King also agreed to pay Luv n' care a total of nearly $900,000 in damages and attorneys' fees for the infringement claims domestically and worldwide. In addition, Royal King agreed to pay a 12% royalty during the sell off period of the products in question. In addition, Luv n' care reserved the right to separately pursue retailers or other third parties selling the accused infringements.
