TORONTO, July 14 /PRNewswire/ -- Silverlit Toys Manufactory Ltd. and Spin
Master Ltd., issue the following corrected notice regarding the settlement of
litigation with Westminster, Inc. and a retailer over the Air Hog(R) Havoc
Heli(TM) and Thunder Wolf(TM) mini helicopters. The litigation was resolved
without admission of liability, subject to the terms of a confidential
settlement agreement.
In dismissing the case, the United States District Court in Atlanta,
Georgia on April 14, 2008 recited certain of the settlement terms and ordered
as follows:
A. Westminster acknowledges the existence of and presumption of validity
of the Patents-in-Suit, and agrees never to challenge or assist others in
challenging the validity of the Patents-in-Suit. KB also acknowledges the
existence of and presumption of validity of the Patents-in-Suit and agrees not
to challenge or assist others in challenging the validity of those patents,
unless those patents are asserted against KB.
B. Payment has been made by Westminster to Silverlit and Spin Master in
consideration of this agreement.
C. Westminster will not make, use, sell, offer for sale or import the
Thunder Wolf, or any remote controlled lightweight mini helicopters using any
of the designs claimed in the Patents-in-Suit, or any claims or designs of the
Silverlit IP.
D. KB agrees not to make, use, sell, offer for sale or import or transport
any Thunder Wolfs, other than the collection, destruction and other duties
provided for in the Settlement Agreement and Release.
E. Violation of the Settlement Agreement and Release may be enforced by
the Court by contempt proceedings.
