Jonathan Evans Announces Recordation of Judgment Against Hitomi Tsuyuki, a
Broker Currently Charged With 200 Felonies
STUDIO CITY, Calif., June 24 /PRNewswire/ -- Jonathan W. Evans recorded a
$371,438.01 judgment against Hitomi Tsuyuki on June 20, 2008, in Orange
County, California. On the same day, the Orange County District Attorney
announced it charged Tsuyuki with 200 felony counts related to a decade-long
scheme to defraud investors.
The civil judgment stems from a securities arbitration claim filed in 2006
by Jonathan W. Evans and Associates on behalf of a small family of investors.
The investors personally knew Tsuyuki through their church. "Tsuyuki abused
his standing in the church to gain his clients' trust and money. Once they
turned their money over to him, he kept most of it for himself," said Evans.
To lull his clients into believing their money was invested pursuant to their
instructions, Tsuyuki altered his employer's account statements to make it
appear the accounts and investments existed.
On March 17, 2008, Jonathan W. Evans and Michael S. Edmiston presented the
case before a FINRA arbitration panel. Just three days after the hearing, the
Panel rendered an award against Tsuyuki, finding that he "acted with the
intent to defraud Claimants and in fact did defraud Claimants." The Panel
awarded compensatory damages, attorney's fees, interest, and $150,000 in
punitive damages to the family. Edmiston stated, "We spent several hours with
the Panel dissecting and comparing the account statements to prove the fraud.
What Tsuyuki did was very sophisticated. We are pleased the Panel saw it as
we did."
"Anyone who has done business with Tsuyuki needs to take a hard look at
their account statements and confirm the money is actually there," warned
Evans. "We are glad to help others who believe they may have experienced the
same treatment by Tsuyuki."
The FINRA arbitration case number is 06-04950 and the award may be found
at http://www.finra.org. Tsuyuki's Orange County criminal case number is
08CF1853.
