UPDATE 1-Juicy Couture sues Victoria's Secret over marketing
(Adds no comment on lawsuit from Limited)
NEW YORK, April 29 (Reuters) - Juicy Couture Inc, whose trendy clothes can be found at Barney's, Bloomingdale's and Saks, filed suit against Victoria's Secret on Tuesday charging the Limited Brands Inc (LTD.N) unit with copying its designs and marketing.
Juicy Couture, a unit of Liz Claiborne (LIZ.N) that had U.S. sales of more than $420 million in 2007, according to the suit filed in U.S. District Court in Manhattan, claims Victoria's Secret has copied its color, pink; mimicked its slogans and imitated its designs, from its "JUICY" workout gear and bathing suits, to calling cards and coin purses.
Juicy Couture, in its complaint, noted the consistent similarity between their own "icons, elements, products and marketing strategy" and those of Victoria's Secret.
The latest copy-cat product, according to the suit, is Victoria Secret's candy packaging. Juicy Couture said it introduced the Sweet Shoppe Trade Dress, wrapped in packages made to resemble lollipops, bonbons, ice cream confections starting in December 2005. Victoria's Secret used similar packaging beginning in October, the lawsuit said.
A Limited spokeswoman told Reuters by e-mail that the company does not comment on pending litigation.
The lawsuit is seeking to enjoin Victoria's Secret from selling or offering for sale any of the clothing that infringes on Juicy Couture's product. It is also asking that the apparently derivative dresses be destroyed and that it be awarded three times the profits that Victoria's Secret earned for the sales.
