ITC Delays Ruling In Apple Inc, Samsung Electronics Co Ltd Patent Dispute-DJ

Dow Jones reported that The U.S. International Trade Commission will delay until May 31 a decision on whether Apple Inc. infringed upon Samsung Electronics Co Ltd patents, Reuters reported March 13, 2013. In September, an ITC judge found that Apple didn't infringe upon four wireless patents held by Samsung. The ruling was subject to review by the other ITC judges. According to the Reuters report, the ITC requested filings related to the effects of a potential ban on certain Apple products.  Full Article

Samsung Electronics Co Ltd Loses Latest Apple Inc's Suit In UK-Reuters

Reuters reported that Apple Inc has won a patent infringement lawsuit in an English court, which exonerates the iPhone maker from charges it unlawfully used Samsung Electronics Co Ltd's technology. Samsung had argued that three individual patents relating to processing and transmitting data on 3G mobile networks had been infringed, but the court found all three claims invalid. Samsung said it was disappointed by the court's decision. Apple declined to comment.  Full Article

Judge Cuts Apple Inc Award Versus Samsung Electronics Co Ltd, Sets New Damages Trial-Reuters

Reuters reported that Apple Inc had a major setback in its ongoing mobile patents battle with Samsung Electronics Co Ltd on Friday, as a federal judge slashed a $1.05 billion jury award by more than 40% and set a new trial to determine damages. Apple won the award last year against Samsung in what was the biggest and highest-profile of a number of legal trials around the world, centered on the use and alleged abuse of patents in a highly competitive mobile market. The iPhone maker convinced the jury that the Korean company had infringed on its iPhone and iPad patents. Friday's ruling by Judge Lucy Koh of the U.S. District Court Northern District of California in San Jose means the two mobile electronics companies may once again square off in a California court to decide how much of the $450.5 million struck from the damages, associated with 14 Samsung products, should stand. Koh said the jury had incorrectly calculated part of the damages and that a new trial was needed to determine the actual, final dollar amount. That could end up less than or more than the original $450.5 million set by the jury. Koh, rejecting Apple’s motion for an increase in the jury’s damages award, ordered a new trial on damages for the 14 devices, which include the Galaxy SII. The jury’s award to Apple for 14 other separate products, totaling almost $599 million, was maintained.  Full Article

Tokyo Court Rules In Favor Of Apple Inc In Samsung Electronics Co Ltd's Patent Case-DJ

Dow Jones reported that a court in Tokyo Thursday ruled against claims by Samsung Electronics Co Ltd that Apple Inc had infringed upon its wireless standard patents. A spokesman for Apple in Korea, reiterated Apple's stance regarding patent lawsuits, saying it will protect Apple's intellectual property. Samsung and Apple are challenging each other in multiple court cases in a number of countries over patents used in mobile phones. Earlier this year, a U.S. appeals court denied Apple's request to ban sales of a Samsung smartphone.  Full Article

Apple Inc To Settle Lawsuit On App Purchases By Kids-Reuters

Reuters reported that Apple Inc has agreed to settle a class action lawsuit that said customers were charged when their children inadvertently downloaded certain applications from the Company's online store. Under the proposed settlement, Apple could potentially end up paying around $100 million as it has agreed to provide a $5 iTunes store credit to as many as 23 million affected customers, the court filing said. The final settlement figure may vary. Also, those claiming $30 or more from Apple may choose to receive a cash refund instead of an iTunes store credit, according to the filing. The lawsuit, filed by five parents in 2011, involved allegations surrounding purchases in certain downloaded apps, which plaintiffs claim were made by children without the knowledge or permission of the account holder.  Full Article

PCCW Ltd's Unit Seeks To Challenge Apple Inc Phone Locking In Court-DJ

Dow Jones reported that the battle over Apple Inc's locked iPhone sales has now reached Hong Kong's shores after a local telecommunications company filed court documents this week seeking to contest restrictions on locked iPhones. According to court documents filed by a unit of PCCW Ltd, the operator has allegedly lost hundreds of millions of Hong Kong dollars because Apple's latest iPhone 5 doesn't function on its fourth-generation network. Apple has come under heavy fire for its phone locking policies in the United States, where for years, the iPhones it sold were only configured to operate on the AT&T network. Most iPhones in the U.S. are still sold locked, limiting the ability of consumers to use the device with different carriers, though Apple now sells unlocked iPhones in the U.S. for a premium over those attached with a calling plan. On September 28, shortly after PCCW discovered that the iPhone 5 wasn't functioning on its fourth-generation network, its unit, Hong Kong Telecommunications, filed a complaint with the city's telecommunications regulator. The effort hasn't yielded any success, prompting the operator to turn to the city's legal system, instead. HKT is seeking a judicial review of the way in which the regulator has dealt with the case.  Full Article

Apple Inc Challenges Loss Of iPhone Trademark In Brazil-Reuters

Reuters reported that Apple Inc, which lost the rights to its iPhone trademark in Brazil on february 13, 2013, is challenging the ruling by Brazil's copyright regulator to prevent local firm Gradiente Eletronica SA from using the iphone brand name. The regulator, Inpi, ruled on february 13, 2013 that the rights to the trademark belong to Gradiente, prompting California-based Apple to request that the decision be reviewed in Latin America's market. Consumer electronics maker Gradiente had filed its request to use the iphone brand in 2000, seven years before Apple launched its smartphone, but received approval to use the trademark only in 2008. Now, in order to keep its trademark rights, Gradiente will need to prove to the regulator in the next 60 days that it made use of the trademark between January 2008 and January 2013, Inpi said late on february 13, 2013.  Full Article

Australia Lawmakers Summon Tech Companies Apple Inc, Microsoft Corp And Adobe Systems Inc-DJ

Dow Jones reported that Australian lawmakers have summoned global technology companies Apple Inc, Microsoft Corp and Adobe Systems Inc to appear before a parliamentary committee investigating the cost of information technology software in the country. The move to force executives to attend the hearing comes as the Australian dollar remains above parity against the greenback. This should make imports cheaper, but consumer advocacy groups and lawmakers say it isn't reflected in prices paid for software products in Australia. The Committee is looking at the impacts of prices charged to Australian consumers for IT products, Australian consumers often pay much higher prices for hardware and software than people in other countries. The IT executives will meet with the committee on March 22 in the Australian capital, Canberra. The inquiry into software prices began in the middle of 2012, but so far no executives from the biggest companies have appeared. International companies operating in Australia routinely blame high production costs and salaries for eroding margins and forcing prices higher.  Full Article

Activist Investor Sues Apple Inc In Bid To Unlock Cash-Reuters

Reuters reported that Apple Inc confronted its first challenge from an activist shareholder in years as hedge fund manager David Einhorn's Greenlight Capital filed suit against the Company and demanded that it dole out a bigger piece of its $137 billion cash pile to investors. Einhorn's lawsuit targets a proposal by Apple to eliminate preferred stock from its charter. He urged Apple shareholders to vote against the plan at the Company's annual meeting on February 27, and put forward a proposal of his own for the Company to issue preferred stock with a perpetual 4% dividend.  Full Article

Apple Inc To Lose iPhone Trademark In Brazil-Reuters

Reuters reported that Brazil's copyright regulator will strip Apple Inc of the right to use its iPhone trademark in Latin America’s biggest market and granted the trademark to a local company that registered it first. The Brazilian Institute of Intellectual Property will officially announce its decision on February 13, 2013. Apple could then challenge the ruling in the Brazilian courts. UPDATE 1-Judge says leaning toward U.S. in Apple e-books case

NEW YORK, May 23 - In an unusual move before a trial, a federal judge expressed a tentative view that the U.S. Justice Department will be able to show evidence that Apple Inc engaged in a conspiracy with publishers to increase e-book prices.
