Koninklijke Ahold reaches agreement in principle to settle Waterbury class action in the United States

Koninklijke Ahold NV:Says it has signed term sheet agreeing in principle to settle class action pending in United States District Court for District of Connecticut in respect of pricing practices of Ahold`s former subsidiary U.S. Foodservice from 1998 to 2005 (Waterbury class).Under term sheet that was signed, Ahold has agreed to pay $297 million into settlement fund in return for release from all claims from all participating class members in relation to these pricing practices.Class comprises any person in United States who purchased products from U.S. Foodservice pursuant to arrangement that defined sale price in terms of cost component plus mark-up and for which U.S. Foodservice used so-called "Value Added Service Provider" transaction to calculate cost component.Settlement is subject to approval by District Court for District of Connecticut, which is anticipated to address issue in late 2014 or early 2015.It is also subject to potential reduction and/or termination based on compensable sales volume attributable to class members that elect to opt out of settlement.  Full Article
