Duke Energy Corp:Agrees to a $2.5 million settlement with Virginia over a massive coal ash spill that coated 70 miles of the Dan River in grey sludge, state environmental officials announced - The Associated Press.The Virginia Department of Environmental Quality said the settlement would include $2.25 million in environmental projects that Duke would perform in communities affected by the spill in Feb 2014.The remaining $250,000 would be placed in a fund for the department to respond to environmental emergencies.The spill originated in Eden, North Carolina, but affected areas in Virginia, too, leaving more than 2,500 tons of the toxic ash backed up behind a dam in Danville.The Virginia settlement is still subject to approval by the State Water Control Board.The consent order does not preclude affected localities from seeking their own settlements with Duke.  Full Article

Duke Energy Corp to pay $146 mln to settle lawsuit over CEO removal - Reuters

Duke Energy Corp:Said it would pay $146 mln to settle a shareholder lawsuit related to the ouster of its chief executive following its merger with Progress Energy in 2012 - Reuters.Duke's board voted to replace Progress CEO Bill Johnson with Duke CEO James Rogers at the helm of the combined company hours after the $18 billion merger closed.Johnson's ouster prompted an investigation by regulators, who had approved the deal on the understanding that he would lead the combined company.Rogers was slated to be executive chairman.Rating agencies also considered cutting Duke's debt rating.The company said the settlement would avoid the cost of prolonged litigation and eliminate uncertainty related to the lawsuit.Insurance will cover most of the settlement amount, while shareholders, not customers, will pay the rest, Duke said.The company said it has a $26 mln reserve for the portion not covered by insurance.  Full Article

Duke Energy Corp:Federal prosecutors filed multiple criminal charges against Duke Energy on Feb. 20 over years of illegal pollution leaking from coal ash dumps at five North Carolina power plants - The Associated Press.The three U.S. Attorney’s Offices covering the state charged Duke with nine misdemeanour counts involving violations of the Clean Water Act.The prosecutors say the company engaged in unlawful dumping at coal-fired power plants in Eden, Moncure, Asheville, Goldsboro and Mt. Holly.Duke said in statements and court filings that it has already negotiated a plea agreement under which it will admit guilt and pay $102 mln in fines, restitution and community service.The company said the costs of the settlement will be borne by its shareholders, not passed on to its electricity customers.The investigation into Duke began last February after a pipe collapsed under a coal ash dump at the Eden plant, coating 70 miles of the Dan River in grey sludge.However, prosecutors allege in court filings that Duke’s illegal dumping had been going back for years, to at least 2010.The separate cases will be consolidated under the jurisdiction of the U.S. District Court in Raleigh.Any proposed settlement in the case would be subject to approval by a judge.  Full Article
