Moscow Arbitration Court Satisfied Gazprombank OAO's Claim Regarding Acquisition Moskovskaya ob"yedinennaya energeticheskaya kompaniya OAO's Shares-Interfax

Interfax reported that the Moscow Arbitration Court on December 21, 2012 invalidated the decision of the Federal Antimonopoly Service (FAS) of July 6, 2012. According to the agency Interfax-AFI, the court granted the petition of Gazprombank OAO. The court obliged the Federal Antimonopoly Service to correct its violations. Earlier was reported that, on July 6, 2012 FAS again refused to give Gazprombank OAO permission to the transaction for the acquisition of 50.9% Moskovskaya ob"yedinennaya energeticheskaya kompaniya OAO (MOESK) shares. The decision to bar the acquisition once again was influenced by several facts, including the Bank's affiliation with Gazprom OAO, according to the regulator's statement. The federal service held that this transaction would combine the power distribution business with the power generation business under a single entity in contravention of the law.
