Reuters reported that Nokia Oyj announced that it won a court injunction that would prevent HTC Corp from using microphone components made by STMicroelectronics NV in HTC One phones. The Company also announced in a statement announcing the decision by the Amsterdam District Court that the microphone components were invented by Nokia and manufactured exclusively for Nokia phones. Nokia Oyj Wins German Patent Ruling Against HTC Corp-Reuters
Reuters reported that a German court ruled in favor of Nokia Oyj, saying some devices made by Taiwan's HTC Corp infringed on its power-saving patent. The case was one of 22 infringement suits Nokia has brought against HTC in Germany. Nokia is pleased with this decision. The power-saving patent refers to a technology for saving battery power while connected to a network. HTC said its business in Germany would not be affected by the Mannheim regional court's ruling as it covers only three handsets it no longer imports into the country. It said it would appeal the decision while also continuing efforts to have the patent declared invalid by the German Federal Patents Court and the English Patents Court. Nokia said it has also asserted the power-saving patent against HTC in the United Kingdom and at the United States International Trade Commission, with a hearing in the United States to start in two months. Immersion Corp To Pursue Damages Against HTC Corporation In District Court
Immersion Corp announced it is seeking termination of the International Trade Commission`s investigation of HTC Corporation for infringement of certain of Immersion`s patents and instead will ask for the stay of its lawsuit in the U.S. District Court to be lifted, so that Immersion may prosecute its claim against HTC for damages immediately. The ITC action was originally scheduled for final determination on October 28, 2013, after which the only remedy available to Immersion is an exclusion order against HTC preventing the importation of infringing devices into the United States. By contrast, the remedy available in U.S. District Court includes damages, attorneys` fees, and potentially injunctive relief. Full Article
German Court Dismisses Nokia Oyj's Complaints Against HTC Corp-DJ
Dow Jones reported that the District Court of Mannheim, Germany, dismissed two of Nokia Oyj's complaints against HTC Corp for infringing a method for using services offered by a telecommunications network, a telecommunications system, and a terminal for it and electronic display device and lighting control method of same. Nokia disagrees with the court's decision and added that more than 30 further Nokia patents have been asserted against HTC in other actions in Germany, the United States and the United Kingdom. WiLan Inc Initiates Litigations Against Apple Inc, HTC Corp and Sierra Wireless Inc
WiLan Inc announced it has initiated five separate litigations claiming patent infringement against Apple Inc. (Apple), HTC Corporation (HTC) and Sierra Wireless America, Inc. (Sierra Wireless). Three of the suits, filed in the Southern District of Florida against Apple, HTC and Sierra Wireless, claim infringement of WiLAN's U.S. Patent Nos. 8,315,640 and 8,311,040 related to LTE technologies. Ken Stanwood, who heads up WiLAN's LTE-focused R&D subsidiary, is a named inventor on both patents and has been developing foundational technology for 4G broadband wireless networks for the past 14 years. The two other suits, filed in the Eastern District of Texas against Apple and Sierra Wireless, claim infringement of WiLAN's U.S. Patent No. 6,381,211 (211 patent) related to 3G HSPA handset products. HTC is a defendant in an ongoing litigation initiated by WiLAN in 2010 that claims infringement of the 211 patent. WiLAN will be represented in all five suits by Vinson & Elkins LLP. Full Article
U.S. Judge Orders Apple Inc To Disclose To Samsung Electronics Co Ltd Details Of Patent Settlement With HTC Corp-DJ
Dow Jones reported that a U.S. judge Wednesday ordered Apple Inc to disclose to Samsung Electronics Co Ltd details of its patent settlement with HTC Corp, a move that could help the Korean company build its case to fight a potential sales ban in the U.S. According to court documents filed with the United States District Court for the Northern District of California, Samsung is seeking 'discovery', a legal term used for when both parties must disclose and exchange evidence to one another, of the settlement agreement to support its opposition to Apple's permanent injunction motion. Samsung believes that a royalty is a more suitable alternative to a permanent injunction, the filing said. Earlier this month, Apple and HTC signed a broad 10-year licensing agreement that settles all of their lawsuits between the companies around the world. Apple first sued HTC in 2010. Samsung and Apple are still fighting it out in global courts accusing one another of patent infringement. In the U.S. case, a federal jury awarded Apple damages of more than $1 billion, but Samsung has vowed to fight the decision. A hearing has been set for December 6, during which a judge will look into Apple's request to ban several Samsung products in the U.S. Full Article

Reuters reported that shares of HTC Corp jumped by their permitted daily limit on November 12, 2012 after the Taiwanese smartphone maker announced a global patent settlement and 10-year licensing agreement with Apple Inc, allowing the struggling company to focus on product development. HTC Corp and Apple Inc's settlement and licensing agreement on November 09, 2012 ended one of the first major conflagrations of the smartphone patent wars. The two companies did not disclose details of the settlement or the licensing agreement, but HTC Corp said the agreement will not impact its financials and it will not change its fourth-quarter guidance.
