InterDigital Inc Receives Initial Determination in USITC Patent Infringement Investigation of Nokia Oyj, Huawei Technologies Co Ltd and ZTE
InterDigital Inc announced that it has received notice that the Administrative Law Judge (ALJ) overseeing the U.S. International Trade Commission (ITC or Commission) Investigation No. 337-TA-800 of Nokia Oyj, Huawei Technologies Co Ltd and ZTE has issued an initial determination (ID) finding no violation of Section 337 of the Tariff Act of 1930. The ALJ found that one of InterDigital's asserted patents was infringed, but the asserted claims of that patent were found to be invalid in light of prior art. He further found that four of InterDigital's patents were not proven invalid but are not infringed, and that the remaining two asserted patents were invalid and not infringed. Importantly, the ALJ indicated that the respondents have not prevailed on any equitable, FRAND, or license defense. The ALJ also determined that InterDigital satisfied the domestic industry requirement as to all asserted patents. Full Article

Federal Circuit Rules In Favor Of Interdigital Inc In Dispute With Lg Electronics Inc
InterDigital Inc announced that the United States Court of Appeals for the Federal Circuit has ruled in favor of the Company in its ongoing dispute with LG Electronics (and LG affiliates). The Federal Circuit determined that LG should not have been terminated from United States International Trade Commission (Commission) Investigation No. 337-TA-800 initiated by InterDigital. LG was terminated from the Commission investigation based on LG's allegation that it has a continuing 3G license under an expired license agreement with InterDigital, and that the parties' dispute over whether LG possesses such a license should be arbitrated under the terms of that agreement. The Federal Circuit panel ruled that LG's assertion of arbitrability was "wholly groundless" and found that there "simply is no plausible argument that LG's license for 3G products survived the termination of the Agreement." By rule, LG and the Commission have 45 days to petition for rehearing of the Federal Circuit's decision and may petition the U.S. Supreme Court for a writ of certiorari within 90 days after entry of the judgment or a request for rehearing is denied, whichever is later. After the time period for petitioning for rehearing passes or the Federal Circuit denies any such petition, the Federal Circuit will issue its mandate remanding the case for further proceedings by the Commission. US Court Not To Review Decision in Case Between Nokia Oyj and InterDigital Inc-Reuters
Reuters reported that a federal appeals court that had revived an InterDigital Inc patent complaint against Nokia Oyj declined on January 10, 2013 to review that decision, according to a court filing. InterDigital filed a complaint at the International Trade Commission (ITC) in 2007 accusing Nokia of infringement. The ITC found that Nokia was innocent, but the United States (US) Court of Appeals for the Federal Circuit revived the complaint and sent it back to the ITC where it is pending. Meanwhile, Nokia urged the appeals court to reconsider its decision by arguing that InterDigital did not manufacture any products using the patents, a requirement for bringing an infringement complaint to the ITC. A divided court declined on January 10, 2013, ruling that licenses that InterDigital has given for the technology fulfills the ITC requirement. InterDigital Inc Files New Complaint Against Huawei Technologies Co Ltd , Nokia, Samsung Electronics Co Ltd And ZTE with U.S. International Trade Commission
InterDigital Inc announced that its wholly owned subsidiaries InterDigital Communications, Inc., InterDigital Technology Corporation, IPR Licensing, Inc. and InterDigital Holdings, Inc. (collectively, "InterDigital") filed a complaint with the U.S. International Trade Commission ("USITC") against Huawei Technologies Co Ltd ., Futurewei Technologies, Inc. d/b/a Huawei Technologies (USA), Huawei Device USA, Inc., Nokia Corporation, Nokia, Inc., Samsung Electronics Company, Ltd., Samsung Electronics America, Inc., Samsung Telecommunications America, LLC, ZTE Corporation and ZTE (USA), Inc. (collectively, "Respondents") alleging that they engaged in unfair trade practices by selling for importation into the United States, importing into the United States and/or selling after importation into the United States certain 3G and 4G wireless devices (including WCDMA-, cdma2000- and LTE-capable mobile phones, USB sticks, mobile hotspots, laptop computers and tablets, and components of such devices) that infringe up to seven of InterDigital`s U.S. patents (the "Asserted Patents").
