US Court Not To Review Decision in Case Between Nokia Oyj and InterDigital Inc-Reuters

Reuters reported that a federal appeals court that had revived an InterDigital Inc patent complaint against Nokia Oyj declined on January 10, 2013 to review that decision, according to a court filing. InterDigital filed a complaint at the International Trade Commission (ITC) in 2007 accusing Nokia of infringement. The ITC found that Nokia was innocent, but the United States (US) Court of Appeals for the Federal Circuit revived the complaint and sent it back to the ITC where it is pending. Meanwhile, Nokia urged the appeals court to reconsider its decision by arguing that InterDigital did not manufacture any products using the patents, a requirement for bringing an infringement complaint to the ITC. A divided court declined on January 10, 2013, ruling that licenses that InterDigital has given for the technology fulfills the ITC requirement. InterDigital Inc announced that its wholly owned subsidiaries InterDigital Communications, Inc., InterDigital Technology Corporation, IPR Licensing, Inc. and InterDigital Holdings, Inc. (collectively, "InterDigital") filed a complaint with the U.S. International Trade Commission ("USITC") against Huawei Technologies Co Ltd ., Futurewei Technologies, Inc. d/b/a Huawei Technologies (USA), Huawei Device USA, Inc., Nokia Corporation, Nokia, Inc., Samsung Electronics Company, Ltd., Samsung Electronics America, Inc., Samsung Telecommunications America, LLC, ZTE Corporation and ZTE (USA), Inc. (collectively, "Respondents") alleging that they engaged in unfair trade practices by selling for importation into the United States, importing into the United States and/or selling after importation into the United States certain 3G and 4G wireless devices (including WCDMA-, cdma2000- and LTE-capable mobile phones, USB sticks, mobile hotspots, laptop computers and tablets, and components of such devices) that infringe up to seven of InterDigital`s U.S. patents (the "Asserted Patents").
