Russian Court to Hear Claims in Rostelekom OAO's and MegaFon OAO's Dispute-RAPSI

RAPSI reported that the Russian arbitration court of appeals has scheduled, for October 30, the hearing of claims filed by Rostelekom OAO (Rostelecom), Sveko, and the Federal Anti-monopoly Service (FAS) after the lower court sided with MegaFon OAO (MegaFon) in an antitrust dispute. In August, the Moscow Arbitration Court sustained a lawsuit filed by MegaFon seeking to contest a ruling by the antitrust service to bar the operator from providing Internet services to the Pension Fund. MegaFon won a one-year contract to provide the Pension Fund with Internet access services at a tender held in March. However, the results of the tender were annulled by FAS, which said that the operator lacked the required experience in providing services to state entities. Under the terms of the tender, the winner must submit a history of contracts that have been implemented and prove that it has provided services to at least 1,000 branches and divisions of any state entity in no less than 80 of Russia’s 83 regions, with contracts signed no earlier than 2011. MegaFon submitted contracts signed by its subsidiary Synterra, but the antitrust service said that Synterra’s experience cannot be regarded as the experience of its parent company. As a result of the antitrust move, little-known company Sveko was declared the winner. In April, the Pension Fund concluded an agreement with the company. State-controlled Rostelecom also took part in the disputed tender.
