ZTE Corp:Says that it has applied to the United States Patent and Trademark Office to re-examine five patents of Vringo Inc and its subsidiaries.Five Vringo patents subject to applications for re-examination are numbered US 7,558,283, US 6,081,534, US 7,126,940, US 5,689,252 and US 7,724,720, respectively, related to telecommunications equipment.Equivalent versions of five US patents have been used by Vringo in litigations with ZTE in the U.K., Germany and India.Patent Re-examination Board of State Intellectual Property Office of the People's Republic of China has invalidated five of Vringo's patents on grounds of lack of invention.  Full Article

Vringo Inc announces update on ZTE litigation

Vringo Inc:Announced the United States District Court for the District of Delaware has dissolved the temporary restraining order and preliminary injunction entered on Feb. 5 in favor of ZTE and against Vringo.On Feb. 5, ZTE filed a lawsuit against Vringo in the United States District Court for the District of Delaware, accusing Vringo of violating contractual obligations made to ETSI, to license standard essential patents on fair, reasonable, and non-discriminatory (FRAND) terms.In its complaint, ZTE asserted that Vringo improperly sought injunctive relief against ZTE around the world and, specifically, in Romania where Vringo received an injunction against ZTE's 4G LTE handsets and equipment.On Feb. 10, 2015, the U.S. District Court for the District of Delaware granted Vringo's motion to dissolve the injunctive relief that the Court ordered on Feb. 6.Court granted Vringo's motion one day after Vringo presented the Court with the full picture of the facts.Court also ordered that ZTE's underlying lawsuit against Vringo be transferred to the U.S. District Court for the Southern District of New York where Vringo brought a lawsuit against ZTE for breach of the parties non-disclosure agreement.  Full Article

Vringo Inc wins LTE handset case versus ZTE in Romania-Telecompaper Europe

Vringo Inc:Vringo Inc received a favorable ruling against ZTE in Romania-Telecompaper Europe.The court rejected ZTE`s attempt to obtain extraordinary relief following the court's earlier rejection of ZTE`s appeal of the injunction.ZTE had petitioned the court to require Vringo Inc to pay a 40 million euros bond to enforce the injunction, an amount it claimed was a more accurate reflection of the damages that ZTE claims to be currently suffering in Romania.The court, in a final decision that may not be appealed, rejected ZTE`s claim as inadmissible.The injunction remains in place pending trial on the merits.The bond, which Vringo Inc must pay to continue to enforce the injunction as per the court's earlier order, remains set at 240,000 euros.As part of its enforcement of the injunction, Vringo Inc informed vendors of ZTE handsets and infrastructure equipment in Romania that the court has ordered them to cease all sales of ZTE 4G/LTE products in Romania.ZTE has previously stated that this injunction would result in losses of over 30 million euros to ZTE as a result of breaching its contracts with telecom providers Telekom Romania Mobile Communications (former Cosmote Romania) and Deutsche Telekom.ZTE is legally forbidden from delivering equipment found by the court to infringe the patent-in-suit to these providers.Vringo Inc provided notice of the injunction to both Telekom Romania Mobile Communications and Deutsche Telekom.  Full Article
