Wal-Mart Stores Inc to pay $150,000 to settle EEOC age and disability discrimination suit - EEOC

Wal-Mart Stores Inc:Has agreed to pay $150,000 and provide other significant relief to settle an age and disability discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC).The EEOC charged in its suit that Wal-Mart discriminated against the manager of the Keller, Texas Walmart store by subjecting him to harassment, discriminatory treatment, and discharge because of his age.The EEOC also charged that Wal-Mart refused to provide a reasonable accommodation for the man's disability as federal law requires.According to the EEOC's suit, David Moorman was ridiculed with frequent taunts from his direct supervisor, including 'old man' and 'old food guy.The EEOC further alleged that Wal-Mart ultimately fired Moorman because of his age.Such alleged conduct violates the Age Discrimination in Employment Act (ADEA), which prohibits discrimination on the basis of age 40 or older, including age-based harassment.The EEOC filed suit on March 12, 2014, after first attempting to reach a pre-litigation settlement through its conciliation process.Under the terms of the two-year consent decree settling the case, Wal-Mart will pay $150,000 in relief to Moorman.In addition, Wal-Mart agreed to provide training for employees on the ADA and the ADEA.Wal-Mart will also report to the EEOC regarding its compliance with the consent decree and post a notice to employees about the settlement.  Full Article

Wal-Mart Stores Inc:A federal agency says Wal-Mart discriminated against a lesbian employee who sought health coverage for her ailing wife and has ordered 'a just resolution' for violating her civil rights - The Associated Press.The U.S. Equal Employment Opportunity Commission ordered the retail giant to work with Jacqueline Cote of New Bedford, Massachusetts, who hopes the determination will help her pay off $100,000 in medical bills.In a Jan. 29 EEOC ruling, obtained on Feb. 18 by The Associated Press, the agency said Cote 'was treated differently and denied benefits because of her sex.Cote tried to enrol her partner in Wal-Mart’s health plan repeatedly starting in 2008, but coverage was denied and the company didn’t provide it until 2014.In 2012, Cote’s wife, Diana Smithson, was diagnosed with cancer.  Full Article

DONOVAN AXLER, LLC:Says that the Supreme Court of Pennsylvania has issued a decision affirming the multi-million dollar class action judgment against Wal-Mart Stores, Inc. in favor of Pennsylvania hourly employees.The Commonwealth's highest Court today issued an opinion that resoundingly affirmed the decisions of two lower courts and a unanimous class action jury verdict issued in 2006.In Oct. 2006, a Philadelphia jury found that 186,000 current and former Wal-Mart employees were owed $78.5 million in unpaid wages for off-the-clock work and paid break violations from March 1998 through April 2006.Subsequently, trial judge Mark I. Bernstein awarded an additional $62.2 million in statutory liquidated damages, $10.2 million in prejudgment interest, $33.8 million in statutory attorney fees and $11.9 million in non-statutory attorney fees, bringing the total judgment to over $180 million.  Full Article
