Cephalon, Inc. And Teva Pharmaceuticals Industries Limited's Barr Settle Patent Infringement Suit-Reuters
Reuters reported that Cephalon, Inc. said it has come to an agreement to settle its patent infringement dispute with Barr Pharmaceuticals over the pain drug Fentora. Under the agreement, Cephalon, Inc. will grant Barr a non- exclusive, royalty-free right to market and sell a generic version of Fentora in the United States. The license will become effective in October 2018. another generic version of Fentora enters the United States market before that date, Barr will be allowed to enter the market at the same time, assuming no other company has won a period of marketing exclusivity. Cephalon, Inc. had claimed Barr infringed Fentora patents that do not expire until 2019. Under the settlement Barr will not attempt to enter the market earlier than October 2018. Barr is owned by the generic drug maker Teva Pharmaceutical Industries Ltd.
Ratiopharm Attracts At Least 10 First Round Bids Including Teva Pharmaceutical Industries Ltd.-Reuters
Reuters reported that German generic drug maker Ratiopharm has attracted at least 10 first-round bids. Bidders from the healthcare industry include Teva Pharmaceutical Industries Ltd., Mylan Inc., sanofi-aventis, SINOPHARM HOLDING CO., LIMITED and Actavis of Iceland. Buyout firms participating in the round of bids, which were non-binding, include TPG, Advent in collaboration with Goldman Sachs, Permira and KKR. One source said EQT also filed a bid. Several sources close to the proceedings also told that most bids came in between EUR2 billion ($3 billion) and EUR2.5 billion. VEM owner Ludwig Merckle is selling Ratiopharm as part of concessions made by his late father to creditor banks.

Teva Pharmaceutical Industries Ltd. announced that the U.S. Food and Drug Administration has granted final approval for the Company's Abbreviated New Drug Application (ANDA) to market its generic version of Tap Pharmaceutical's proton pump inhibitor Prevacid (lansoprazole) Delayed-Release Capsules, 15 mg and 30 mg. Customers will begin receiving product on November 11, 2009.

Teva Pharmaceutical Industries Ltd. announced that the U.S. District Court for the District of Delaware has issued a decision in its litigation over the Company's Abbreviated New Drug Application (ANDA) to market its generic version of Takeda Pharmaceuticals North America, Inc.'s Prevacid (Lansoprazole) SoluTab. The Court found that the Company's generic lansoprazole orally disintegrating tablets do not infringe U.S. Patent No. 5,464,632. Teva intends to complete an analysis of the decision before deciding upon its next course of action.
Teva Pharmaceutical Industries Ltd. Wants To Add 3 More Patents To Suit Against Momenta Pharmaceuticals, Inc. and Novartis AG's Sandoz over Copaxone-AP
The Associated Press reported that Teva Pharmaceutical Industries Ltd. said it plans to expand a suit against Momenta Pharmaceuticals Inc. and Novartis AG's Sandoz Inc., which are hoping to market a generic version of Teva's multiple sclerosis drug Copaxone. Teva is now saying the two companies are violating ten patents on Copaxone, up from seven claimed in a lawsuit filed by Teva in fiscal 2008. Teva wants to amend its lawsuit to include the additional patents. Copaxone is under patent protection until 2014, and the three extra patents do not expire until after that, Teva said.
