Tessera Technologies, Inc. announced a status update on its current legal actions. On October 30, 2009, the International Trade Commission (ITC) announced that it will review portions of the Initial Determination by the Administrative Law Judge (ALJ) in the ITC action brought by Tessera against certain DRAM manufacturers and sellers. The Commission will review, among other things, whether the respondents infringed the Tessera patents asserted in the action. The Commission`s Final Determination is scheduled to be issued by Dec. 29, 2009. The action is Investigation No. 337-TA-630 (DRAM ITC action).

Tessera Technologies, Inc. announced that for the third quarter of 2009, it has raised total revenue guidance to a range of $65.0 million and $66.0 million compared to prior guidance range of $60.0 million and $62.0 million. According Reuters Estimates, analysts on an average were expecting the Company to report revenue of $62.1 million for the third quarter of 2009. The Company cited that increase in micro-electronics revenue driven by the improved second quarter performance in the Company's served markets as the main reason for raising third quarter 2009 revenue outlook. 

 
Tessera Technologies, Inc. Announces Federal Circuit Denies QUALCOMM Inc., Spansion Inc. and STMicroelectronics N.V.'s Motion To Stay ITC Wireless Orders

Tessera Technologies, Inc announced that the Court of Appeals for the Federal Circuit has denied the respondents' motion to stay the U.S. International Trade Commission's (ITC) Limited Exclusion Order (LEO) and Cease and Desist Orders (CDOs) in Investigation No. 337-TA-605 (Wireless ITC Action). Under the Federal Circuit's order denying a stay, the ITC's LEO and CDOs will remain in full effect while the Federal Circuit considers the respondents' appeal. The respondents in the Wireless ITC action are ATI Technologies, Freescale Semiconductor, Inc., Qualcomm, Inc., Spansion, Inc., Spansion, LLC and ST Microelectronics N.V. Tessera asserted infringement of two Tessera patents, U.S. Patent No. 6,433,419 (`419) and U.S. Patent No. 5,852,326 (`326). Motorola, Inc., which had been a party to the action, has signed a license agreement with Tessera, and is permitted to import and sell otherwise unlicensed infringing products. 

 
ITC Issues Initial Determination In Tessera Technologies, Inc.'s DRAM ITC Action

Tessera Technologies, Inc. announced the Administrative Law Judge (ALJ) in the International Trade Commission (ITC) action brought by Tessera against certain DRAM manufacturers issued an Initial Determination finding Tessera`s asserted patents are valid, but not infringed by the respondents. The action is Investigation No. 337-TA-630 (DRAM ITC action). The ALJ`s decision, termed an "Initial Determination," is subject to review by the full Commission. Within 120 days of the issued Initial Determination, the Commission can affirm, modify or reverse the ALJ`s decision in developing the ITC`s final determination. The respondents in the DRAM ITC action include Acer, Inc., Centon Electronics, Inc., Elpida Memory, Inc., Kingston Technology Co., Inc., Nanya Technology Corporation, Powerchip Semiconductor Corp., ProMOS Technologies Inc., Ramaxel Technology Ltd., Smart Modular Technologies, Inc., and TwinMOS Technologies, Inc. Tessera is asserting infringement of three Tessera patents, U.S. Patent No. 5,663,106 (`106), U.S. Patent No. 6,133,627 ('627), and U.S. Patent No. 5,679,977 (`977) and is seeking, among other things, an exclusion order barring importation of infringing products that incorporate the patented technology.
