Jubilant supporters of Uhuru Kenyatta celebrate outside the Kenyan High Court on Friday. Inside the judge has ruled he can run in the upcoming presidential elections. Kenyatta and his running mate William Ruto are accused by the International Criminal Court of orchestrating tribal violence that killed 1,200 people after the last vote in 2007. The judge said that under the Rome Statute, the ICC and the Kenyan courts cannot simultaneously adjudicate on the same matter. He said only the ICC could bar them from running but that the Rome Statute has no such provisions. Ethnic rivalries fed the post-election fighting five years ago. This time round little has changed - Kenyatta and his rival Prime Minister Raila Odinga both head largely ethnic-based coalitions with few ideological differences. According to opinion polls Kenyatta is running a close second to Odinga ahead of the March 4th election. If Kenyatta wins, his first overseas trip as president could be to appear in court in the Hague, at a hearing scheduled for April.
