A California woman ticketed for driving while wearing Google Glass, had her citation dismissed today. The San Diego court commissioner said he found no proof that the tiny computer, mounted on an eyeglass frame, was turned on while she was driving. Technology entrepreneur Cecilia Abadie was stopped for speeding back in October. She was one of thousands of people testing the device for Google. And she showed up to court wearing those glasses. The officer who gave her the citation called on his own expert witness: (SOUNDBITE) (English) EXPERT, SAYING: "The black spot, on the front portion of it is where the camera lens finder would be." (SOUNDBITE) (English) COURT COMMISSIONER JOHN BLAIR, SAYING: "Sir, I have a question of clarification, have you actually used this device?" (SOUNDBITE) (English) EXPERT, SAYING: "I have not used this device your honor." (SOUNDBITE) (English) COURT COMMISSIONER JOHN BLAIR, SAYING: "How is this not hearsay for you to be testifying about the exact same information that I wouldn't allow in written form, if you have no personal information regarding this. And you're just giving me the information you read about." Abadie considers the ruling a success. (SOUNDBITE) (English) CECILIA ABADIE, SAYING: "I believe it's an initial success, but there's a long way to go to actually make sure this is safer even. And make sure that people understand it." The court also dismissed the speeding ticket she received on that day.
