Comedian Tracy Morgan sues Wal-Mart in federal court, alleging the retailer was negligent in connection with the June crash that left him critically injured and killed a fellow passenger. Mana Rabiee reports.

Comedian Tracy Morgan is suing Walmart in a New Jersey federal court. The actor says the retailer was negligent in connection with that deadly accident in June that left Morgan critically injured and killed a fellow passenger. The driver of the Walmart truck was later charged with vehicular homicide in that crash. Court papers filed on Thursday say Walmart knew -- or should have known -- that its driver, 33-year-old Kevin Roper, had been awake for more than 24 hours before the crash. The complaint maintains Walmart's driver broke federal regulations designed to prevent driver fatigue. Federal investigators say Roper was driving 20 miles over the speed limit when the crash occurred. Morgan was transferred to a rehab center last month after two weeks in a New Jersey hospital. He and the other plaintiffs in the lawsuit are seeking unspecified damages and attorney fees.
