No ruling yet on fantasy sports feud

There was no immediate decision after arguments were made in a court hearing Wednesday about the legality of daily fantasy sports in New York. Bobbi Rebell reports.

Daily fantasy sports companies FanDuel and DraftKings fighting for their New York survival in court Wednesday. The state has been trying to shut them down, calling them a rebranding of sports betting which is illegal. In court arguing the contests involve factors outside the contestants control, like player performance, which makes them games of chance. The companies say the contests are legal - because they are games of skill - and pointed out that the seasonal versions of the games are legal. Both, DraftKings and FanDuel, are private companies with high profile investors, valuations of more than a billion dollars, and deep pockets. Baruch College Law Professor & Fantasy Sports Attorney Marc Edelman: (SOUNDBITE) MARC EDELMAN, LAW PROFESSOR AND FANTASY SPORTS ATTORNEY, BARUCH COLLEGE, (ENGLISH) SAYING: "Draft Kings went out and hired David Boies, who is one of the most well known attorneys in America, to represent them. They are using the best defense they can here. But, at the same time, Draft Kings has certain contests such as one day fantasy golf and one day fantasy nascar that are going to be very difficult to defend as games of skill under New York law." The judge said he will rule very soon- which legal experts say will likely be in a week or two.
