STORY: The message from a Los Angeles judge to Roman Polanski - you are still a fugitive. The 40-year-old rape case against the famous director remains open and unresolved even after the woman he assaulted asked for the case to be dismissed. In June, Samantha Geimer, who was 13 years old when she was raped, said she had forgiven Polanski and asked the court to dismiss the case so she and her family could move on. Judge Scott Gordon said in a ruling that Polanski remained a fugitive from justice and that the court could not dismiss a case - quote - 'merely because it would be in the victim's best interest.' Polanski, who turns 84 this week, has never returned to the U.S. and according to this latest ruling will not anytime soon.
