Case to Watch: 9th Circuit to weigh fate of abusive debt collection lawsuit

The 9th U.S. Circuit Court of Appeals will hear arguments Monday over whether to revive a lawsuit seeking to hold a debt collector liable for trying to collect a debt based on a factual mistake.

The case, which will be argued before Circuit Judges Margaret McKeown, William A. Fletcher and Ronald Gould, has drawn amicus briefs from consumer groups, who say a lower court’s ruling dismissing the case threatens consumers, and from debt collectors, who say reviving it could impose impossible burdens.
