Foreclosure alone does not trigger FDCPA protection - 9th Circuit

A property foreclosure proceeding that does not attempt to enforce any debt beyond the proceeds from the property’s sale cannot trigger the protection of the federal Fair Debt Collection Practice Act, a federal appeals court ruled Tuesday.

The decision by the 9th U.S. Circuit Court of Appeals is a victory for Fannie Mae, which had sought to foreclose on a property held by Oregon resident Timothy Barnes.
