Judge preserves lawsuit over foreclosure-related home break-ins

An Illinois man who says he was locked out of his home and his property taken after he was mistakenly reported to be in default on his mortgage can proceed with a lawsuit against a property maintenance company for trespass and other claims, a federal judge ruled.

In a decision on Wednesday, U.S. District Judge John Tharp in Chicago rejected Indiana-based BaXol’s argument that it is not liable for trespass because it did not physically enter the man’s property but subcontracted the work out to a vendor, which was not under its control.
