Judge asked to reject Chipotle's bid to stay overtime pay case

A former Chipotle Mexican Grill Inc employee has told a federal judge in New Jersey that the company’s “brazen” bid to hold her in contempt of an order blocking an Obama administration overtime pay rule should not hold up her proposed wage-and-hour class action.

Lawyers for Carmen Alvarez in a filing on Tuesday asked U.S. District Judge Kevin McNulty in Newark to reject Chipotle’s attempt to stay the case pending the outcome of its contempt motion, which it filed earlier this month in a federal court in Texas.
