9th Circuit says ACA didn't ban lifetime caps on retiree health benefits

A U.S. appeals court on Friday ruled that a ban on lifetime caps on health benefits in the Affordable Care Act does not apply to plans that only cover retirees.

A unanimous three-judge panel of the 9th U.S. Circuit Court of Appeals said that while the lifetime caps are lawful, UPS violated disclosure requirements under the Employee Retirement Income Security Act in 2010 by failing to adequately notify retirees that a $500,000 cap applied to them.
