2nd Circuit says New York state can block pipeline construction

By Barbara Grzincic A federal appeals court on Friday upheld New York state’s decision to deny approval for a 121-mile pipeline designed to bring natural gas from the hydraulic fracturing fields of Pennsylvania to upstate New York and New England.

A unanimous three-judge panel of the 2nd U.S. Circuit Court of Appeals said New York’s decision to deny the pipeline a water-quality permit was supported by the owners’ failure to provide information requested by the state, principally about their plans for crossing 251 New York streams.
