U.S. says lawsuit over malathion review should be tossed

The U.S. government on Friday urged a judge to dismiss a lawsuit by environmental groups claiming it violated the Endangered Species Act by delaying reviews of pesticides containing malathion.

In a motion filed in U.S. District Court in Oakland, California, the U.S. Environmental Protection Agency and the U.S. Fish and Wildlife Service argued that the Center for Environmental Health, Californians for Pesticide Reform and Center for Biological Diversity are improperly challenging the government’s review of 21 pesticide products containing malathion.
