Fact Check-Dominion’s lawsuits against Giuliani and Powell are still ongoing, despite claims the voting company lost circulating online

The defamation lawsuits of voting machine manufacturer Dominion Voting Systems against former U.S. President Donald Trump’s lawyers Rudy Giuliani and Sidney Powell are still ongoing, contrary to claims made online.

A widely-shared tweet from May 8 that claims Dominion Voting Systems had “lost” both litigation processes had garnered more than 9,000 retweets as of the time this article was written ( here ) (archived here ).

“Why is this news not headlining on all platforms??,” a user commented ( here ).

“Just another article u won't see in main stream media or as we know it #FAKENEWS SO HERE YA GO, REAL NEWS!,” a second one wrote ( here ).

Dominion and another voting software firm, Smartmatic, have brought several lawsuits against people who spread conspiracy theories related to their voting machines after the 2020 presidential election that Trump lost to President Joe Biden.

A representative at public affairs firm Hamilton Place Strategies, responding on behalf of Dominion Voting Systems, told Reuters via email on May 10 that the lawsuits are “ongoing.” They directed Reuters to Dominion's Legal Updates webpage ( here ).

It is not the first time that this claim has been shared falsely. Reuters previously debunked similar posts in June 2021 ( here ). USA TODAY also addressed these claims in November 2021 ( here ).

Both litigation processes can be found in CourtListener.com ( www.courtlistener.com/ ), a website run by the nonprofit organization Free Law Project ( www.free.law/ ). The latest court filings of the Dominion lawsuits against Giuliani can be seen ( here ) and against Powell ( here ). Neither show the cases being dismissed.

Further proof that the lawsuits are still ongoing is a scheduling order issued by the District Court for the District of Columbia back in March 2022 ( bit.ly/3L35g0s ) that states that the Court “intends to discuss” the potential trial dates at a conference scheduled for July 11, 2023.

In January, Reuters reported that Dominion told a court there was “no realistic possibility” that the voting machine manufacturer would reach settlements in its billion-dollar defamation lawsuits against Giuliani and Powell ( here ).

VERDICT

False. As of May 10, 2022, Dominion Voting Systems’ defamation lawsuits against Rudy Giuliani and Sidney Powell are ongoing, contrary to social media posts.
